Terms of Use

1. Who May Use WordHive

You may use many parts of WordHive without creating an account. You must be at least 13 years old to create or use a WordHive account. Younger children may use guest play only with a parent, guardian, teacher, or other responsible adult’s supervision, and should not be asked to provide personal information.

If you are under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian. A parent or legal guardian who permits a minor to use the Service agrees to these Terms on the minor’s behalf and is responsible for supervising that use.

You may not misrepresent your age, help another person bypass an age restriction, or create an account for a child under 13. If you believe a child under 13 has created an account or provided personal information through an account feature, use the WordHive.app contact form.

If you use the Service on behalf of a school, business, library, organization, or other entity, you represent that you are authorized to accept these Terms on its behalf. In that case, “you” includes both you and that entity where the context permits.

2. Parents, Guardians, and Educators

WordHive.app is a family-friendly, general-audience word-game and learning service. Parents, guardians, and educators are responsible for deciding whether particular games, words, advertisements, external links, custom entries, and features are appropriate for a particular child. We do not knowingly request personal information from children under 13 for an account, and our child-safety practices are described in the Privacy Policy.

Educators who use WordHive are responsible for:

• having any authorization required by their school, board, library, organization, or applicable policy;
• supervising learners appropriately;
• deciding whether WordHive content and activities suit their learners, curriculum, and learning goals;
• using custom and sharing features in a way that protects student privacy; and
• complying with applicable laws, institutional policies, consent requirements, and record-handling obligations.

WordHive.app is not a student information system, learning management system, official assessment platform, educational-record repository, or school records custodian. Ordinary use of the Service does not create a school-vendor, data-custodian, fiduciary, or similar institutional relationship. Schools or organizations that need contractual commitments about student data, security, retention, or support should contact us before using the Service for that purpose.

Do not enter confidential student records, grades, accommodation details, disability or health information, contact information, account credentials, or other sensitive personal information into custom lists, classroom-turn features, shared wheels, display names, or similar fields. Where a classroom feature calls for participant labels, use first names, initials, group names, team names, or pseudonyms where practical.

3. Accounts and Account Security

When creating an account, you must provide accurate information, use a valid email address that you are authorized to use, and select an appropriate display name. You are responsible for keeping your account credentials confidential and for activity conducted through your account.

Your account is personal to you. You may not sell, rent, license, transfer, trade, share, or advertise the sale or transfer of an account. You may not create duplicate accounts to evade restrictions, obtain improper rewards, manipulate rankings, or mislead other users.

You must notify us promptly through the WordHive.app contact form if you believe your account, email address, referral link, or credentials have been compromised or used without permission. We may require reasonable verification before restoring access, changing account information, responding to an account request, or disclosing account-related information.

Display names must be suitable for a family-friendly service. They must not:

• reveal sensitive personal information;
• impersonate another person or organization;
• falsely imply affiliation with WordHive or another person;
• infringe intellectual property, privacy, publicity, or other rights;
• contain abusive, hateful, threatening, sexual, deceptive, discriminatory, or unlawful material; or
• be used to advertise, solicit, redirect, or distribute spam.

We may reject, change, reserve, or remove a display name that violates these Terms, creates confusion, poses a safety concern, or interferes with the Service.

4. Limited Licence to Use the Service

Subject to these Terms, the Operator grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the Service for lawful personal, family, and educational purposes.

This licence allows ordinary browser use, gameplay, learning activity participation, dictionary lookup, reasonable browser caching, use of built-in sharing controls, and the educational uses described below. It does not transfer ownership of any WordHive Content or grant any right to use the WordHive.app name, logos, branding, source code, databases, game systems, or other protected materials except as expressly stated.

Permitted educational use

Parents, guardians, teachers, tutors, students, homeschoolers, libraries, and nonprofit educational organizations may display, print, or reproduce reasonable portions of WordHive Content for ordinary instruction and learning, including in live lessons, lesson plans, classroom slides, interactive whiteboards, homework, student reports, presentations, and similar educational materials.

This permission also applies where an educator or tutor charges ordinary fees for instruction, provided that WordHive Content is incidental to the instruction and is not itself sold, licensed, republished, or marketed as a separate product.

Permitted educational use is subject to all of the following conditions:

• use only the amount reasonably needed for the lesson or activity;
• preserve any copyright, attribution, trademark, and proprietary notices;
• do not make systematic or bulk copies of WordHive dictionary entries, questions, answers, word lists, examples, or activities;
• do not publish substantial WordHive Content on a public website, public repository, application, course library, or downloadable resource collection;
• do not sell, sublicense, redistribute, or create a commercial product substantially based on WordHive Content;
• do not present WordHive Content as your own or alter it in a way that misrepresents WordHive; and
• do not use the permission to create a substitute for the Service, a competing learning resource, a competing word game, or a hosted copy of WordHive Content.

Broader use requires our prior written permission. Nothing in these Terms limits a right that applicable law gives you and does not permit us to restrict, including any applicable fair dealing or similar right.

5. Acceptable Use and Fair Play

You may use the Service only lawfully, safely, and in accordance with these Terms. You may not, directly or indirectly:

• cheat, fabricate activity, manipulate outcomes, or misrepresent gameplay, learning results, referrals, rewards, streaks, rankings, or achievements;
• use bots, scripts, macros, automated browsers, fabricated events, emulators, multiple accounts, or coordinated activity to gain an unfair advantage;
• exploit, conceal, publicize for abuse, or repeatedly benefit from a bug, vulnerability, timing issue, unintended reward path, or configuration error;
• bypass, disable, evade, probe, or interfere with authentication, rate limits, security controls, access restrictions, consent controls, anti-abuse systems, or technical instructions;
• gain or attempt to gain unauthorized access to an account, database, server, network, administrative area, or non-public part of the Service;
• upload, transmit, introduce, or distribute malware, malicious code, destructive instructions, corrupted data, or anything intended to damage, monitor, disrupt, or gain unauthorized access;
• interfere with the operation of the Service or another person’s use of it, including through denial-of-service activity, excessive requests, harassment, or deliberate disruption;
• reverse engineer, decompile, disassemble, decode, derive source code from, or attempt to discover the underlying structure, ideas, algorithms, game logic, security controls, or non-public data of the Service, except to the limited extent a non-waivable law expressly permits;
• copy, mirror, frame, reproduce, modify, republish, distribute, sell, sublicense, rent, commercially exploit, or create derivative products from WordHive Content except as expressly permitted by these Terms or applicable law;
• use the Service to infringe or violate copyright, trademark, trade secret, privacy, publicity, contractual, or other rights;
• collect, solicit, expose, or misuse another person’s personal information, particularly information about a child;
• impersonate another person or organization, misrepresent your affiliation, or falsely imply sponsorship, endorsement, approval, employment, agency, or partnership by WordHive.app or Innovative Edge Consulting;
• use the Service or its sharing features for spam, phishing, fraud, unlawful solicitation, deceptive promotion, harassment, hate, threats, sexual exploitation, abuse, or other unlawful or harmful activity;
• submit, share, or distribute material that is defamatory, obscene, sexually explicit, exploitative, threatening, hateful, discriminatory, invasive of privacy, or otherwise unsuitable for a general family audience;
• use the Service to develop, market, support, or operate a substantially similar or competing dictionary, learning activity, word game, answer bank, solver, content library, reward system, or service through unauthorized use of WordHive Content or systems; or
• encourage, assist, or enable another person to do any of the above.

Security research, penetration testing, vulnerability testing, and automated testing of the Service require our prior written permission. Please report suspected security issues privately through the WordHive.app contact form rather than exploiting or publicly disclosing them.

6. Automated Access, Scraping, Datasets, and Artificial Intelligence

Except with our prior written permission or where a non-waivable law expressly permits otherwise, you may not use any robot, spider, crawler, scraper, automated browser, automated query, data-mining tool, extraction tool, monitoring system, or similar technology to access, search, download, copy, monitor, index, harvest, or compile any part of the Service or WordHive Content.

Without limiting the restriction above, you may not use WordHive Content, Service data, or unauthorized copies of either to:

• create, enrich, verify, or maintain a dataset, corpus, directory, dictionary, thesaurus, answer bank, question bank, word list, knowledge base, or content repository;
• train, pre-train, fine-tune, ground, augment, retrieve for, validate, test, benchmark, evaluate, or improve an artificial-intelligence, machine-learning, large-language, speech, search, recommendation, or generative system;
• create embeddings, vector indexes, retrieval-augmented generation resources, synthetic training data, model outputs, or automated summaries at scale;
• reconstruct or infer WordHive databases, content structures, questions, answers, scoring rules, reward rules, difficulty classifications, commonness classifications, or game logic;
• provide WordHive Content through an API, feed, extension, bot, assistant, application, or other service; or
• build, improve, or operate a competing or substitutive product or service.

A general-purpose public search engine may crawl publicly accessible pages solely to create ordinary public search results, but only in accordance with our robots.txt file, rate limits, and other published technical instructions. This search-engine permission does not authorize AI training, dataset creation, bulk archival, commercial extraction, or republishing.

An ability to access content technically does not mean that we have authorized its collection or reuse.

7. User Content, Custom Lists, and Shared Configurations

“User Content” means content you provide through the Service, including display names, custom words, names, teams, groups, classroom-turn entries, prompts, sentences, custom lists, wheel configurations, suggested words, communications, and other material you enter, submit, save, or share.

You retain any ownership rights you have in your User Content. When you provide User Content to a feature that requires WordHive to process, display, encode, store, transmit, or share it, you grant WordHive a limited, non-exclusive, worldwide, royalty-free licence to do those things only as reasonably necessary to:

• provide and operate the feature you selected;
• display or transmit the User Content at your direction;
• maintain security, prevent abuse, troubleshoot, and provide support;
• comply with law and enforce these Terms; and
• allow service providers acting on our behalf to perform those functions.

This licence lasts only as long as reasonably necessary for those purposes. It may continue for a limited period in backups, security records, legal holds, abuse-prevention records, or copies outside our control. User Content that remains only in your browser or device is not received by us merely because you created it locally.

You are solely responsible for your User Content and the consequences of entering, saving, or sharing it. You represent that:

• you own the User Content or have all rights and permissions needed to use and provide it;
• the User Content and our limited use of it as described above will not infringe or violate another person’s rights;
• the User Content is accurate where accuracy matters; and
• the User Content complies with these Terms and applicable law.

Do not provide confidential information, trade secrets, account credentials, financial information, government identifiers, precise location information, health information, protected educational records, or other sensitive personal information. Do not include a child’s full name, contact information, or other unnecessary identifying information in a custom or shareable activity.

Shared links and configurations

A shared link may allow anyone who receives it to view, copy, reopen, or save the entries or configuration associated with it. Treat shared links as potentially public. Recipients may forward, copy, screenshot, or retain shared material outside WordHive’s control. Do not use a shared link for confidential, private, or sensitive information.

The Operator does not endorse User Content and is not required to pre-screen or continuously monitor it. User Content may not meet WordHive.app’s family-friendly editorial standards. We may review, block, remove, disable, restrict, preserve, or report User Content or shared configurations where we reasonably believe they violate these Terms, infringe rights, create safety or legal risk, threaten the Service, or must be addressed by law.

8. Honey, Badges, Avatars, Hints, Streaks, and Rank

Honey is an in-service reward unit. Eligible players may earn Honey through qualifying activities and use spendable Honey for eligible virtual features, such as avatars or hints. Lifetime Honey may be used for ranks, badges, achievements, or leaderboard calculations even after spendable Honey is used.

Honey, badges, avatars, hints, streaks, ranks, entitlements, achievements, and other virtual items are limited, personal, revocable licences to use digital features within the Service. They:

• are not money, property, currency, securities, deposits, investments, gift cards, or gambling prizes;
• have no cash value and cannot be redeemed, withdrawn, exchanged, sold, transferred, traded, inherited, or used outside the Service;
• do not create a vested right or entitlement to continued access;
• may be subject to eligibility rules, limits, expiry, inventory, pricing, availability, and technical requirements; and
• may be changed, corrected, delayed, denied, reversed, recalculated, suspended, or removed as described in these Terms.

We may change reward amounts, earning opportunities, prices, limits, inventories, badge criteria, streak rules, rank calculations, eligible activities, and virtual features at any time. We may correct or reverse Honey, virtual purchases, ranks, streaks, badges, or results affected by error, duplication, abuse, unauthorized access, rule violations, technical issues, or suspected manipulation.

You may not sell, purchase, trade, transfer, advertise, or broker an account, Honey, a virtual item, an achievement, a rank, or a reward. Except where law requires otherwise, virtual transactions completed with Honey are final and unused Honey or virtual items may be forfeited when an account is deleted, suspended, or terminated.

Our service records may be used to resolve discrepancies involving rewards, results, streaks, and rankings, subject to correction where an error is identified and to any rights required by law.

9. Sharing and Referrals

The Service may allow eligible users to share results, configurations, pages, or referral links. Built-in sharing tools are provided for lawful, personal use.

A referral, visit, click, share, registration, or other action does not necessarily qualify for a reward. Qualifying actions, limits, attribution rules, eligibility periods, and reward amounts may be described in the Service or in additional referral rules.

When sharing or referring, you must not:

• send unsolicited, bulk, deceptive, or unlawful messages;
• send a commercial electronic message without any consent or other legal basis required by applicable anti-spam or marketing law;
• misrepresent your identity or relationship with WordHive;
• state or imply that you are a WordHive employee, agent, partner, or representative;
• offer an unauthorized incentive, make a false claim, or use misleading promotional language;
• use paid, automated, fraudulent, incentivized, or misleading traffic without our written permission;
• refer yourself or create duplicate, fictitious, controlled, or coordinated accounts;
• place links on a website or service in violation of its rules; or
• manipulate attribution, cookies, browser storage, devices, or account records.

We may investigate referral activity, impose limits, withhold or reverse rewards, disable links, remove eligibility, or end a referral program where misuse is suspected or where the program changes. Participation does not create an employment, agency, franchise, partnership, joint venture, or representative relationship with WordHive.

10. Public Profiles, Leaderboards, and Results

Leaderboard and public-profile participation is optional where the feature is offered. If you enable it, visitors may be able to see limited information such as your display name, selected avatar, rank, lifetime Honey, collected badges, and other achievements identified when you enable the feature.

Do not use a public display name or profile element that reveals information you do not want others to see. You may disable public visibility through the available account settings. Removing visibility stops current display through WordHive, but search-engine caches, browser caches, screenshots, forwarded links, and copies made by others may remain outside our control.

Scores, rankings, streaks, badges, achievements, game outcomes, and learning results may change as activity is processed, validated, corrected, removed, or recalculated. Displayed results may be delayed or affected by browser state, device settings, network conditions, fraud controls, or technical errors.

The Operator may determine eligibility, scoring, ranking, reward, and fair-play matters using its records and reasonable judgment, subject to applicable law and correction of confirmed errors. We do not guarantee that any result, rank, streak, profile, or leaderboard position will be permanent or preserved.

11. WordHive Content and Intellectual Property

“WordHive Content” includes the Service and its original or curated text, definitions, simple definitions, examples, hints, clues, practice questions, answers, word lists, classifications, selection and arrangement of content, dictionary and learning entries, puzzles, games, rules, scoring systems, reward systems, databases, software, source and object code, interfaces, graphics, illustrations, artwork, audio, animations, badges, avatars, page designs, branding, and other materials provided by WordHive.

WordHive.app’s original text, artwork, software, page designs, selection and arrangement of content, and other protectable elements of WordHive Content are owned by Innovative Edge Consulting or the applicable licensors and are protected to the extent provided by copyright and other applicable laws. All rights not expressly granted in these Terms are reserved.

Nothing in these Terms claims ownership of the English language, individual words, general facts, ideas, third-party materials, or names and marks belonging to others. Our rights may apply to original expression, editorial treatment, definitions, examples, questions, artwork, software, selection, coordination, arrangement, compilation, databases, game design, and other protectable elements.

Third-party names, trademarks, content, open-source software, data, images, fonts, audio, and other materials remain the property of their respective owners and may be subject to separate notices or licence terms. A reference to a third party does not imply sponsorship, endorsement, affiliation, or approval.

You may not remove, obscure, or alter a copyright, trademark, attribution, licence, or proprietary notice included with the Service or WordHive Content.

12. WordHive.app Identity, Independence, and Linking

WordHive.app is an independent browser-based word-game and learning service operated by Innovative Edge Consulting at wordhive.app. References to “WordHive.app,” “WordHive,” “we,” “us,” or “our” in these Terms refer only to that Service and its Operator.

WordHive.app is not affiliated with, endorsed by, sponsored by, or associated with any third-party mobile application, website, company, product, or service that uses “WordHive,” “Word Hive,” or a similar name, unless we expressly state otherwise on the Service.

We do not claim ownership of or exclusive rights in the names, trademarks, logos, applications, products, or services of unrelated third parties. Third-party names, trademarks, and logos belong to their respective owners.

You may use a normal text link to a publicly available WordHive.app page if the link is lawful, accurately identifies its destination, and does not falsely suggest sponsorship, endorsement, affiliation, approval, employment, or partnership. You may not impersonate WordHive.app or Innovative Edge Consulting, falsely present a third-party service as an official WordHive.app service, or frame, mirror, or reproduce WordHive Content in a way that creates confusion about its source.

If you believe the Service creates confusion with another company, application, product, or service, please contact WordHive.app.

13. Feedback, Suggestions, and Rights Complaints

Feedback and suggestions

If you voluntarily send us an idea, suggestion, correction, feature request, game concept, word request, or other feedback, you agree that we may consider, use, adapt, develop, disclose, or implement it without restriction, confidentiality obligation, attribution, or compensation to you. This does not transfer ownership of material that is independently protected and submitted for another expressly agreed purpose.

Do not send confidential business information, unpublished inventions, or material you do not want us to use unless we have first signed a written confidentiality agreement.

Copyright and other rights complaints

If you believe material available through the Service infringes your copyright, trademark, privacy, publicity, or other legal right, send a written notice through the WordHive.app contact form and include:

1. your full name and reliable contact information;
2. identification of the work, mark, information, or right you believe is affected;
3. the exact WordHive page, link, or location of the material;
4. an explanation of the claimed infringement or violation;
5. information showing that you own the right or are authorized to act for the rights holder;
6. a statement that you believe in good faith that the disputed use is not authorized by the rights holder, its agent, or law; and
7. a statement that the information in your notice is accurate.

We may request additional information, forward relevant portions of a notice to the person who provided the material, temporarily restrict access while reviewing a dispute, restore material where appropriate, or take no action where a notice is incomplete or unsupported. The Operator does not act as a court and may require the parties to resolve disputed ownership or rights through appropriate legal processes.

We may restrict or terminate accounts of repeat or serious infringers where appropriate.

14. Advertising, External Links, and Third-Party Services

The Service may display advertisements, sponsorship messages, or third-party content and may link to websites, products, services, or resources that we do not own or control. An advertisement, link, reference, or integration does not mean that the Operator endorses, guarantees, recommends, or is responsible for the third party.

We do not control every third-party advertisement, destination, offer, product, service, statement, security practice, or privacy practice. Your interactions, communications, purchases, disputes, and transactions with a third party are between you and that third party and may be governed by separate terms and privacy policies.

To the fullest extent permitted by law, the Operator is not responsible for losses or harm arising from third-party websites, advertisements, products, services, content, or conduct. Review third-party terms, privacy practices, age guidance, and purchase information before interacting with them.

The Operator relies on service providers for functions such as hosting, content delivery, authentication, database services, email, analytics, advertising, security, and infrastructure. Providers and integrations may change over time. Our Privacy Policy explains relevant data-handling practices.

15. Learning, Dictionary, Pronunciation, and Game Disclaimers

WordHive definitions, simple definitions, examples, pronunciations, audio, word lists, synonyms, antonyms, related words, word families, hints, clues, difficulty labels, commonness labels, grade or age suggestions, practice questions, feedback, puzzle answers, scores, and other learning materials are provided for general educational and entertainment purposes.

Language varies by region, dialect, accent, community, subject area, context, and time. As a result:

• a word may have meanings, spellings, usages, pronunciations, or connotations not shown by WordHive;
• pronunciation and speech features may vary by browser, device, selected voice, accent, or technical availability;
• difficulty, commonness, reading-level, age, and grade labels are editorial guidance rather than formal classifications;
• a word’s inclusion or exclusion is not a definitive statement that it is accepted by every dictionary, curriculum, examination, competition, word list, or third-party game;
• examples and practice feedback may not cover every valid interpretation or answer;
• automated or interactive feedback may not identify every error; and
• the Learning Dictionary and other resources are not exhaustive.

WordHive.app is not an official examination, certification, tutoring, grading, diagnostic, speech-language, or educational-assessment service. We do not guarantee improved grades, vocabulary, spelling, pronunciation, fluency, memory, game performance, or any other learning outcome.

Do not rely on WordHive as the sole source for a high-stakes academic, professional, medical, legal, financial, safety, accessibility, or other consequential decision. Consult an appropriate teacher, curriculum source, specialist, professional, or authoritative reference where accuracy is important.

16. Family-Friendly Design and Content Limits

The Operator aims to design and review WordHive.app’s games, learning activities, dictionary content, and public-facing materials for a general and family-friendly audience. That is an editorial goal, not a guarantee that every item encountered through the Service will be suitable for every child, family, classroom, culture, or circumstance.

Third-party advertisements and destinations, User Content, custom entries, shared configurations, browser-generated speech, external links, and content outside WordHive’s control may not follow WordHive’s editorial standards. Parents, guardians, and educators should supervise younger users and review custom or shared material before presenting it to a group.

If you find WordHive.app-provided content that appears inappropriate, inaccurate, or unsafe, please report the page and concern through the WordHive.app contact form so we can review it.

17. Availability, Local Data, and Product Changes

We may add, update, correct, test, redesign, limit, pause, suspend, or remove any part of the Service at any time, including games, puzzles, questions, dictionary pages, archives, tools, custom features, accounts, rewards, advertisements, public features, sharing features, and integrations.

We do not guarantee:

• uninterrupted, timely, secure, or error-free access;
• compatibility with every browser, device, operating system, assistive technology, network, or location;
• that a particular game, word, feature, reward, advertisement, archive entry, or service provider will remain available;
• preservation or synchronization of guest progress, local browser data, custom wheels, settings, guesses, missed words, streaks, shared configurations, or other locally stored information;
• successful recovery of deleted, lost, corrupted, expired, or inaccessible data; or
• that beta, preview, experimental, or newly released features will operate as expected or become permanent.

Browser clearing, private browsing, storage limits, device replacement, extensions, security tools, account changes, or technical failures may remove local data. You are responsible for retaining your own copy of User Content that is important to you.

We may establish or change usage limits, eligibility rules, technical requirements, regional availability, and feature-specific rules. Additional terms displayed for a promotion, contest, new feature, or future paid service will apply to that offering. If additional terms conflict with these Terms, the more specific terms control for that offering unless they state otherwise.

18. Suspension, Restriction, and Account Deletion

You may stop using the Service at any time. Where account deletion is available, you may request or complete deletion through the account settings or contact method provided.

We may, with or without advance notice where reasonably appropriate, investigate, restrict, block, suspend, or terminate access; remove or disable User Content or shared links; reset credentials; reverse rewards; correct records; or take other protective action if we reasonably believe that:

• you violated these Terms or additional feature rules;
• an account or activity is fraudulent, compromised, automated, abusive, or unlawful;
• your use threatens another person, WordHive, a service provider, or the security or integrity of the Service;
• action is required by law, court order, legal process, or a service provider;
• continued access could expose WordHive or another person to legal, security, operational, or reputational risk; or
• immediate action is needed to prevent harm or preserve evidence.

We are not required to provide access to an account, feature, reward, rank, User Content, or data after suspension, deletion, or termination, except where applicable law requires otherwise. Account deletion and data retention are further described in our Privacy Policy.

When your access ends, the licence granted to you under these Terms ends. Sections concerning User Content licences, intellectual property, feedback, rights complaints, disclaimers, liability, indemnity, dispute terms, and any other provision that by its nature should continue will survive.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Service and all WordHive Content, User Content, advertisements, links, features, results, rewards, and related materials are provided “as is” and “as available,” at your own risk.

The Operator disclaims all representations, warranties, and conditions, whether express, implied, statutory, or collateral, including any implied warranty or condition of merchantability, quality, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, quiet enjoyment, or compatibility.

We do not warrant that the Service will meet your requirements; produce a particular educational, entertainment, ranking, or reward result; be uninterrupted or free from errors, harmful components, loss, or unauthorized access; or that defects will be corrected immediately or at all.

Nothing in these Terms excludes, restricts, or modifies a warranty, condition, right, or remedy that applicable law does not allow us to exclude, restrict, or modify.

20. Limitation of Liability

To the fullest extent permitted by law, Innovative Edge Consulting and its owners, directors, officers, employees, contractors, agents, licensors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, aggravated, or punitive damages, or for loss of data, local browser content, custom lists, progress, scores, results, Honey, virtual items, badges, streaks, rank, reputation, revenue, profit, opportunity, goodwill, or anticipated savings arising out of or related to the Service or these Terms.

This exclusion applies regardless of the legal theory, including contract, tort, negligence, strict liability, statute, equity, or otherwise, and even if the possibility of loss was known or foreseeable.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of:

1. the amount you paid directly to Innovative Edge Consulting for the Service during the 12 months immediately before the event giving rise to the claim; and
2. CAD $100.

The exclusions and cap above apply collectively to all claims and all potentially responsible Operator parties, not separately to each claim or person. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury where that limitation is unlawful, breach of a non-waivable legal obligation, or any other liability that applicable law does not permit us to limit.

Nothing in these Terms limits liability that applicable law does not allow to be limited or excluded. Some jurisdictions do not allow certain warranty disclaimers, damage exclusions, or liability limits, so some provisions may not apply to you to the extent of that prohibition.

21. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Innovative Edge Consulting and its owners, directors, officers, employees, contractors, agents, licensors, affiliates, and service providers from third-party claims, proceedings, losses, liabilities, damages, judgments, and reasonable legal costs arising out of or related to:

• your User Content;
• your unlawful, fraudulent, abusive, or unauthorized use of the Service;
• your breach of these Terms or additional feature rules;
• your violation of another person’s intellectual property, privacy, publicity, contractual, or other rights; or
• messages, promotions, referrals, links, or materials you distribute in connection with the Service.

We will provide reasonable notice of a covered claim where practical. We may control the defence and settlement of the claim, and you agree to provide reasonable cooperation. We will not agree to a settlement that imposes a non-monetary obligation or admission on you without your consent, unless the obligation arises from stopping conduct that violates these Terms or law.

22. Changes to These Terms and Electronic Notices

We may update these Terms as WordHive, the Service, technology, risks, and legal requirements evolve.

For non-material changes, the revised Terms may take effect when posted, with the updated date shown above. For material changes that meaningfully affect account holders’ rights or obligations, we may provide additional notice before or when the changes take effect, such as by email, an in-product message, a prominent website notice, or an account reacceptance request, as appropriate and as required by law.

We may require you to accept revised Terms before continuing to use account, reward, public, custom, or sharing features. If you do not agree to revised Terms, you must stop using the affected Service and may delete your account.

You agree that notices and contractual communications may be provided electronically, including through the Service or to the email address associated with your account. You are responsible for keeping that email address current and for reviewing notices made available to you.

23. Governing Law and Disputes

These Terms and disputes relating to them or the Service are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection, small-claims, jurisdiction, venue, or other rights that apply to you, you and Innovative Edge Consulting agree that disputes will be brought before the courts located in Ontario, Canada.

Before starting a formal proceeding, we encourage you to use the WordHive.app contact form with a clear description of the issue so that the parties can attempt to resolve it. This informal step does not prevent either party from seeking urgent relief or affect a legal limitation period.

24. General Terms

Entire agreement

These Terms, our Privacy Policy, and any additional terms or rules presented for a particular feature, promotion, contest, or service form the entire agreement between you and Innovative Edge Consulting concerning the Service and replace prior or contemporaneous communications on the same subject.

Order of precedence

If additional terms expressly conflict with these Terms, the additional terms control only for the feature or offering they govern. Otherwise, these Terms continue to apply.

Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written permission. We may assign or transfer these Terms, in whole or in part, to an affiliate or in connection with a financing, reorganization, merger, acquisition, sale, transfer of assets, or change in the operation or ownership of the Service, subject to applicable law.

Force majeure

The Operator is not responsible for delay, interruption, or failure caused by events beyond our reasonable control, including internet or utility failures, hosting or provider outages, cyberattacks, labour disputes, natural disasters, fires, floods, epidemics, war, civil unrest, government action, or changes in law.

Relationship of the parties

These Terms do not create an employment, agency, partnership, joint venture, franchise, fiduciary, school-custodian, or representative relationship between you and Innovative Edge Consulting. You have no authority to bind Innovative Edge Consulting.

No third-party beneficiaries

Except for Operator parties expressly protected by the warranty, liability, and indemnity provisions, these Terms do not give enforcement rights to another person.

Severability

If a court finds a provision of these Terms unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary, and the remaining provisions will continue in effect.

No waiver

A failure or delay in enforcing a provision is not a waiver. A waiver is effective only if it is in writing and applies only to the specific circumstance for which it was given.

Headings and summaries are provided for convenience and do not change the meaning of these Terms.
